
SOCIETY REGISTRATION
A society is an organization wherein a group of individuals with similar interests get together to perform some activities. A said society is governed by the Societies Registration Act of 1860. This act has been amended by the respective states. A society is registered and governed as per the said act. The registration of a society is needed to promote the fine arts, science, literature for charitable purposes. However, a society is also formed for the maintenance of a residential or commercial complex or to create the Apartment Association.
ONLINE SOCIETY REGISTRATION PROCESS
To register a society, the following conditions must be fulfilled:
- A minimum of seven members are required for a state society. A minimum of eight members from eight different states (one in Delhi) is madatory
- The jurisdiction for a registered society falls under the District Registrar of the area where it’s located
- A society is governed by the Societies Registration Act of 1986
- The property of the society lies in the name of the society. The same property can be sold as per the provisions mentioned in the bye-laws of the society
- The dissolution of the society is as per the bye-laws of the society. After dissolution and settlement of all debts and liabilities, the funds and property of the society will not be distributed among the members of the society. The remaining funds and property will be given or transferred to some other society with similar objectives
- The board of a Society comprises of an Executive Committee which is made up of the President, Secretary, Vice President, Treasurer. The General Body of a Society comprises of all the members of the Society
- A Society has to file the annual details with the Registrar of Societies. These details include a list of the names, addresses and occupations of the managing committee members
DOCUMENTS REQUIRED FOR SOCIETY REGISTRATION
- The Memorandum of Association which contains the name of the society, registered office address of the society, the area of the society’s operations, and the objectives for which the said society has been formed
- The bye-laws of the society is considered as the constitution of the society. The bye-laws consist of the role and responsibilities of the Executive Committee members that include the President, Vice President, Secretary, Joint Secretary and Treasurer. The bye-laws also mentions the qualification of the members, eligibility, the term of the committee, the termination clauses. The bye-laws also contains the other processes needed for the functioning of the said society
- The proof of registered office such as the rental agreement or ownership document
- The identity proof of all the members of society
- Two witnesses are have to sign the registration form
- The list of all the Society compliances
A trust after its registration will do the following:
- Get a PAN card
- The trust will open a bank account
- It will do all the bookkeeping and accounts
- It will file annual IT returns
- It will apply for Professional tax registration, if that is applicable to the said trust
- The trust will apply for GST registration if that is applicable
- The filing of the AGM resolution in regards to the accounts to be disclosed and member list has to be filed with the Registrar of Firms
ELIGIBILITY OF TAX EXEMPTION
There is a general belief that a Society does not need to pay tax as they work towards the welfare of the common public at large. That is not true. A Society, like any other legal entity, has to pay tax. In order for a Society to be exempted from Tax, it must obtain certification for the said exemptions, such as Section 12 A, 80G etc. from the Income Tax Authorities in India.
